Terms of Use

1Parties and scope

These Terms of Use (“Terms”) govern your use of the MarineBase mobile app and the marinebase.app website (together “MarineBase”). MarineBase is operated by Yağız Altınışık (“we”, “us”). By downloading the app, creating an account or using MarineBase you accept these Terms. If you do not accept them, do not use MarineBase.

How we process personal data is described in the Privacy Policy. If a translation differs, the Turkish version of these Terms prevails where the law allows.

2What MarineBase offers

MarineBase is an app with a marketplace where users publish boats for sale and charter, a guide to marinas, harbours and shelters on the Turkish coast, and weather and sea forecasts. You can browse listings, the coastal guide and the forecasts without an account; you need one to publish a listing, save favourites, report a listing or block a user.

3We are not a party to sales or charters

MarineBase only hosts listings. We are not a party to any sale, charter, payment, deposit, handover or other agreement between users; we take no payments for these transactions and give no guarantee.

We do not verify listing details, the condition or papers of a boat, or a seller’s authority. Before you agree, see the boat in person, check its registration documents and the other party’s identity, and get a survey if needed. Do not send a deposit or payment before you have seen the boat and its papers.

Disputes between users are resolved between the parties. Report suspected fraud in the app and contact the police if necessary.

4Your account

• You must be at least 18 to create an account and publish listings.
• You must give your real name, an email address and a phone number that belongs to you. Each phone number can be linked to one account only.
• You are responsible for keeping your password secret and for activity on your account. If you think someone else has used it, change your password and tell us.
• Your name and phone number are shown publicly in your listings.
• Trying to get around the free listing allowance, for example by creating and deleting accounts or registering with someone else’s number, is not allowed.
• You can delete your account in the app at any time (Delete your account).

5Listing and content rules

You are responsible for the listings, photos and other content you publish. Your listings must concern a real boat that you own or are authorised to sell or charter, contain an accurate price and details, and use photos of that boat that you took or have permission to use.

The following are not allowed:

• illegal, fraudulent, fake or misleading listings, or boats that do not exist,
• obscene, sexual or violent content, hate speech, discrimination, insults or threats,
• posting other people’s personal data, photos or contact details without permission,
• content that infringes copyright, trademarks or other intellectual property,
• duplicate listings for the same boat, unrelated advertising, spam or listings meant to send people to other sites,
• harassing, threatening, misleading or abusing other users,
• trying to break the app’s security, access another account or use the service in bulk by automated means.

We have zero tolerance for objectionable content and abusive users.

6Automatic checks, reporting, blocking and moderation

• Automatic check before publication. The listing title and description, profile name and business profile text are compared with a list of blocked terms on our server before they are saved. Content that matches is rejected; you can change the text and try again. The check runs on our server and your text is not sent to third parties for it. It does not catch every piece of objectionable content, so reporting, blocking and review below continue to apply.
• Use Report listing on any listing page to report it with a reason: suspected fraud, inappropriate content, duplicate listing or other. The listing owner is not told who reported it.
• Use Block user to hide a seller’s listings from your account. You can unblock them under Profile > Account > Blocked users.
• We review reports within 24 hours. We remove or hide content that breaks these rules and close the account of the user who posted it.
• We may also remove content, or suspend or close accounts, without a report when we find a breach of these rules. We comply with lawful requests from the authorities.
• A listing hidden by moderation cannot be republished or renewed. If you believe a decision was wrong, write to destek@marinebase.app.
• People without an account can report illegal content by emailing the listing title to destek@marinebase.app.

7Content licence

You keep the rights to the text and photos in your listings. By publishing a listing you give us a worldwide, non-exclusive, royalty-free, non-transferable permission to host, store, technically adapt (for example resize or compress), display and show your content to other users in the app’s listing, search and featured areas. We may use our service providers for this.

This permission exists only to run the service and ends when you delete the content or your account. Copies in backups are deleted at the end of the backup cycle. You confirm that you have the right to grant this permission.

8Paid packages and subscriptions

You can publish a certain number of listings free of charge. The free allowance depends on the campaign in effect when you created your account and is shown under Profile > Account > Listing Packages. Editing a listing does not use up an allowance; deleting a listing or your account does not restore one.

The app offers these packages for additional needs:

• Single Listing: the right to publish one boat listing for 30 days (one-time purchase).
• Featured Listing: feature an existing listing for 7 days (one-time purchase).
• Professional and Corporate: monthly auto-renewable subscriptions with more active listings at a time, a business profile and further features depending on the package.

The current contents and price of each package are shown on the purchase screen in the app before you buy.

Payment and automatic renewal

• Purchases are made through Apple’s App Store in-app purchase system. Payment is charged to your Apple ID account when you confirm the purchase. Your card or bank details never reach us.
• Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription on your iPhone under Settings > [your name] > Subscriptions. Cancellation takes effect at the end of the current period, and your package benefits continue until then.
• Deleting the app or your MarineBase account does not cancel a subscription.
• When a subscription ends, listings published under it stop being shown. Featured credits included in the Corporate package are limited to their period and do not carry over.
• You can restore purchases on another device signed in with the same Apple ID.
• Apple takes the payment, so refund requests are decided by Apple under its own rules: reportaproblem.apple.com.
• Subscription price changes are notified to you in advance under Apple’s rules.

9Apple and the App Store

Downloading the app from the App Store and your licence to use it are governed by Apple’s Licensed Application End User License Agreement (Standard EULA). These Terms supplement the Standard EULA with rules specific to the MarineBase service.

These Terms are between you and us, not Apple. We, not Apple, are responsible for the app, its maintenance, support and content, and for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10Weather, sea and map information

Weather and sea forecasts come automatically from Open-Meteo’s numerical weather and wave models. They are model forecasts, not official marine forecasts, storm or navigational warnings, or navigation or safety-of-life information, and they may be delayed, incomplete or wrong. Conditions inside harbours and coves can differ from the forecast.

Marina, harbour and shelter information is compiled from OpenStreetMap data; coverage may be incomplete, details may be out of date and positions are approximate.

The decision to sail rests with the skipper. Before you sail, check the Turkish State Meteorological Service’s official marine forecasts and current navigational warnings. In an emergency in Türkiye, call 112.

11Intellectual property

The MarineBase name, design and software, and all content other than user content, belong to us or are used under licence. Except where the law allows, you may not copy, modify, reverse engineer or commercially exploit them.

12Limitation of liability

We run MarineBase with care, but we do not guarantee that it will be uninterrupted, error-free or always available. Maintenance, updates or our providers may cause interruptions.

To the extent permitted by law, we are not liable for loss arising from sales, charters or payments between users, the accuracy of listings, the conduct of users, or decisions made on the basis of forecast, map or marina information.

Our liability for intent and gross negligence, and any liability that cannot be limited by law, is unaffected. Nothing in these Terms affects your statutory rights as a consumer.

You are responsible for loss arising from third-party claims made against us because of your content or your breach of these Terms.

13Closing an account

You can delete your account at any time. We may suspend or close your account if you breach these Terms, put other users or the service at risk, or where the law requires it. If we shut the service down entirely, we will announce it in the app or on this site reasonably in advance.

14Changes to these Terms

We may update these Terms when the service or the law changes. The current text is published at this address with the date at the top. We announce significant changes in the app or on this site before they take effect. Continuing to use MarineBase after a change means you accept the updated Terms.

15Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Consumers in Türkiye may apply, within the monetary limits, to the consumer arbitration committee or consumer court where they live or where the transaction took place. For other disputes the courts and enforcement offices of Türkiye have jurisdiction. Consumers living in another country keep the protection of the mandatory consumer laws of that country.
